Cosby team triumphant, but retrial looms

Bill Cosby's defense lawyer says he is concerned about the entertainer's health following what he described as an "unfair" aggravated indecent assault trial that ended in a mistrial Saturday. When the judge announced a mistrial a little after 10 a.m., questions loomed about what could have possibly happened to cause the jury to become so hopelessly deadlocked in this high-profile case, and whether the Montgomery County District Attorney's Office would take on the 79-year-old comedian a second time.

District Attorney Kevin Steele said immediately after the mistrial that he would retry Cosby.

But, the "Girls" actress, best known for her popular Lenny Letter, was not alone in her sentiments.

Chloe Goins, a former model who said Mr Cosby drugged and sexually abused her at the Playboy Mansion in 2008, is also suing the comedian on sexual battery and other claims.

For those who grew up with Bill Cosby's comedy, feelings of sadness shouldn't be confused with sympathy in appraising a legacy that - whatever the eventual outcome of the criminal case against him, in which a jury on Saturday failed to reach a verdict - has already been forever tarnished.

Bill Cosby's legal team likely has an edge in a retrial.

Former federal prosecutor David Weinstein said Cosby's celebrity nearly certainly played a role in the jury's deliberations, perhaps to convince "two or three jurors that it's impossible to convict Dr. Huxtable, to convict Fat Albert. that he couldn't have done this disgusting thing".

Cosby was accused of sexually assaulting Andrea Constand in 2004.

Ultimately, she said, "The jury wants information that supports their position". "She's entitled to a verdict in this case".

Constand told prosecutor Kristen Feden she was unable to stop the sex attack because her body was "limp" - the result, she claimed, of the unidentified pills Cosby suggested she take to help her "relax".

"For Cosby, mistrial. For his 60 accusers, no justice", tweeted lawyer Lisa Bloom, who is representing Janice Dickinson's separate case against the comedian.

In a recorded deposition, the TV star confessed to plying women with sedatives before having sex with them.

Andrea later told police that he had drugged her in such a way that she could not keep her eyes open. But Montgomery County Judge Steven O'Neill only allowed one, Kelly Johnson. But the judge sent them back to try to reach a unanimous verdict. "I've handled a lot of cases but I wasn't quite prepared for what I would see". "He was not going to use his family as shield - that's not who he is- and I respect him for that". Constand has done so.
