Cosby alternate juror 'probably' would have convicted

Kevin R. Steele, the district attorney from Montgomery County, Pennsylvania, has already said he will seek a new trial against Cosby.

The jury deadlocked at the end of the two-week trial, resulting in a mistrial Saturday.

Other county agencies, including courthouse security and building maintenance, also have yet to tabulate their costs associated with the Cosby trial.

The most compelling piece of evidence for him, he told the radio station, was a phone conversation secretly recorded by the mother of Cosby's central accuser, Andrea Constand, in 2005 and played for jurors in court.

Publicist Andrew Wyatt raised a clenched fist as he led the legally blind Cosby out of the courthouse after the jury deadlocked Saturday, while cameras popped and his lead defense lawyer walked away.

The names of the jurors who failed to reach a verdict in Bill Cosby's sexual assault trial have not been made public, but the judge in the case could revisit the issue as early as Monday. "A mistrial is simply the justice system at work", O'Neill said, thanking jurors and urging them not to feel that they let the justice system down.

McCloskey heard all of the testimony and saw all of the evidence presented to the jury, but was not involved in the deliberations.

One alternate juror, Mike McCloskey, 43, posted a picture of his jury badge on social media and spoke briefly with WDVE-FM in Pittsburgh.

The jurors for the first trial were already hard to find and chosen from a pool in Pittsburgh rather than Philadelphia where the alleged sexual assault took place and the trial was held.

He described the journey across the state of Pennsylvania as "the craziest, eeriest bus ride I've ever taken". O'Neill has so far resisted requests by the media to release the names of the jurors.

The jurors clearly struggled with their verdict, telling the judge on Thursday they were at impasse. Media outlets scrambled to speak to women who alleged he had abused them; 35 of them posed for the cover of NY magazine.

Prosecutors are fighting to keep the jurors' identities a secret, arguing in court documents Monday that releasing them would result in a "publicity onslaught" and make picking a jury for the second trial more hard.

The judge will consider whether to release the jurors' names at a hearing on Tuesday.

McCloskey is the first of the jurors to speak out about the trial.

"We came here looking for an acquittal, but like that Rolling Stones song says, 'You don't always get what you want, sometimes you get what you need, '" defense lawyer Brian McMonagle told reporters. Andrea Constand of Toronto has claimed that, during a visit to his home in 2004, Cosby gave her pills which incapacitated her.

Cosby also is battling sexual battery or defamation cases still pending by 10 women in California and MA. The second time around, are they coming with an agenda? "Everyone knows that cases don't get better with time".

Whatever comes next, and the prosecutor has vowed to retry the case, the most important question the trial leaves unanswered is this: When are we going to update our antiquated statutes of limitations - the legal limits that a modern understanding of sexual assault should have forced us to rethink decades ago? His deposition testimony in her civil suit revealed the man who has a bestselling book about fatherhood had procured Quaaludes for the objective of having sex with women who were not his wife.
